DMCA Takedowns & Counter-Notices
17 U.S.C. § 512
What happens in practice
- A rightsholder (or claimant) sends a takedown notice to a service provider.
- Content may be removed/disabled quickly to maintain safe-harbor protection.
- A counter-notice can be used to dispute (risk exists; don’t improvise).
What to document
- Original upload file, timestamps, edit history (show transformation).
- Takedown notice details, URLs, claim IDs, all emails.
- Why you believe it is fair use (keep it factual).
